On Monday, a New Jersey Superior Court judge prevented NJ's Tidelands Resource Council from re-hearing an application for a permit to fill part of the Delaware River for its Route 29 construction project.
The Council's Tuesday hearing was called off after the court issue an injunction stating that the Council could not re-hear the matter until it had developed guidelines for such situations. A petition for the injunction had been filed by the Tri-State Campaign, NJPIRG Citizen Lobby and South Trenton Residents Against Route 29. The Trentonian said the Council's rules could take months to draft, potentially throwing the ready-to-go highway project into disarray.
In May, the Council rejected the DOT's first request for a permit, after a hearing in which citizens and waterfront experts blasted the degradation of riverfront access and traffic increases the project would cause.
NJDOT's approach to the permit seems to be to bring the issue back to the Council until it issues a result favorable to DOT. One Council member told the Trenton Times that applicant hope for a different result might not be sufficient grounds for a re-hearing.
