In MTR #421, we reported that the NY State bill hiking fines for truck drivers who deviate from approved NYC truck routes required a City Council "home rule resolution" before it could be sent to the governor for final approval. However, according to City Council member David Yassky, the legislation does not require the resolution and will head straight to the Governor’s office. The bill raises fines to $200-$2,000 depending on prior offenses. The original bill included a license points provision, which was removed before it was approved by the Senate and Assembly. Apparently, this provision’s removal means it no longer needs the home rule resolution. Albany sources say the driver’s license element was removed out of deference to the state Dept. of Motor Vehicles, which administratively sets rules for charging points. Legislators said the DMV is committed to changing its point system to include the original provisions. We hope lawmakers follow through with the DMV in this regard, because it is the only policy developed so far that will put real teeth into the city’s enforcement of truck routes.
